Biden DOJ Sues To Block Arizona’s Proof Of Citizenship Voting Law

Calling it a ‘textbook violation of the Nationwide Voter Registration Act’

The Biden administration  sued Arizona on Tuesday to block a new law requiring  proof of citizenship in order to vote in federal elections.

Calling it a  “ textbook violation of the National Voter Sign up Act, ”   Assistant Attorney General Kristen Clarke of the Justice Department’s Civil Rights Division stated that the law’s requirement had been “ onerous” – and took particular issue with provisions such as “ requiring political election officials to reject voter registration forms based on mistakes or omissions that are not material to establishing a voter’s eligibility to forged a ballot. ”

The new law would require voters to verify citizenship using documentation like a driver’s license, passport, birth certification or naturalization papers.

Clarke added the new law, scheduled to consider effect in January after it was signed into regulation by GOP Gov. Doug Ducey, is similar to an Arizona law struck down by US Supreme Court in 2013.

The match describes how the attorney with regard to Arizona legislators warned them that the bill would break federal law and contradict the earlier Supreme Court judgment . House Speaker Pro Tempore Travis Grantham mentioned trying again “ is really a fight worth having, ” according to the court filing.

State Attorney General Mark Brnovich suggested the Proper rights Department was encouraging unrecorded immigrants to vote by filing the lawsuit . “ I will once again be in court defending Arizona contrary to the lawlessness of the Biden administration, ” Brnovich said Tuesday. – NBC News

State AG Indicate Brnovich said in response to the particular lawsuit:   “ Arizona has passed a law that turns the particular clock back on improvement by imposing unlawful and unnecessary requirements that would block eligible voters from the enrollment rolls for certain federal polls , ” tweeting later on: “ It’s another round of Brnovich v. Biden as his DOJ proceeds its attempts to undermine our election integrity laws and regulations. ”

As  ABC13   notes:

Arizona Lawyer General Mark Brnovich told Clarke in a  letter   that  he intendeds to defend Arizona’s H. B. 2492 all the way up to the U. S i9000. Supreme Court if needed . He pointed in order to his victory in a separate election integrity suit from last year, in which  he argued successfully in front of the Supreme Court that Az election integrity laws plus policies did not violate the nation’s Voting Rights Act or maybe the Constitution.

In his notice, Brnovich chided Clarke as well as the DOJ for using its sources “ to challenge a common sense law, ” while at the same time the Biden administration can be “ opening our edges to encourage a ton of illegal immigration. ”

Brnovich questioned whether the DOJ was attempting “ to undermine [Arizona’s] sovereignty” and “ destabilize” the state’s election infrastructure.

“ I hope that is not your intention, ” he observed. “ I strongly desire you to reconsider your quest for this misguided suit and also to instead recognize Arizona’s constitutional authority to conduct legitimate and secure elections. ”

According to Gov. Ducey, the determine would address the more than 11, 000 voters in 2020 that had not supplied proof of citizenship, in a condition where President Biden won by less than 11, 500 votes.
