DOJ Appeals Judge’s Decision In order to Block Agency From Accessing Seized Mar-a-Lago Docs

Justice Department scrambling to prevent special master review of categorized documents seized by the FBI at Trump’s Mar-a-Lago vacation resort, claiming such a move might endanger national security.

The Department of Proper rights asked a federal appeals court on Friday to prevent Judge Aileen Cannon’s judgment preventing it from accessing classified documents seized through former President Donald Trump’s Mar-a-Lago residence.

“ The area court has entered an unprecedented order enjoining the Executive Branch’s use of its very own highly classified records in the criminal investigation with direct implications for national security, ” the Justice Division wrote in its  motion   to the U. S. Court associated with Appeals for the 11th Circuit.

“ By enjoining the review plus use of the records bearing classification markings for criminal-investigative reasons, the district court’s order impedes the government’s efforts to protect the Nation’s security. ”

“ Individual has no claim for the come back of those records, which fit in with the government and were seized in a court-authorized search, ” the Justice Department published.

“ The particular records here are not merely related evidence; they are the very items of the offense, ” the agency added.

This comes after Judge Canon on Thursday denied the DOJ’s motion to access the particular the subset of classified records seized by the FBI at Mar-a-Lago on Aug. 8.

Judge Cannon on Thursday  appointed former FISA Judge Raymond Dearie as special master to oversee the review of the particular seized documents, barring the particular DOJ from accessing individuals materials.

Dearie was one of the judges exactly who signed off on the FISA warrant authorizing the FBI’s surveillance of Trump fically Carter Page in 2016.

The DOJ claimed in its appeal the fact that appointment of a special learn “ irreparably harms the government by enjoining critical measures of an ongoing criminal analysis and needlessly compelling disclosure of highly sensitive information, including to Plaintiff’s lawyer. ”

It the FBI had a strong case against Trump, it should welcome the appointment of a third-party review.

But in fact, it’s working desperately to prevent a special master from reviewing the categorized documents.

From Forbes :

The DOJ had  said   it would appeal Cannon’s order granting a special master to review the Mar-A-Lago documents if she didn’t stroll it back by allowing the particular agency to hang on to the classified documents— which she did not.

Cannon  ruled   Thursday that previous U. S. District Determine Raymond Dearie— whom she appointed as special master— will review even categorized documents, rejecting the DOJ’s request because the agency “ presupposes” that all the paperwork are classified and normally are not covered by executive or attorney-client privilege, which she failed to agree with.
